Article 1 (Purpose) These terms and conditions (hereinafter referred to as “Agreement”) are designed to define the rights, obligations, and responsibilities of both the Cyber Mall operated by Enzychem Lifesciences USA Corp. (hereinafter referred to as “Mall”), an e-commerce business, and the users (hereinafter referred to as “Users”) in relation to the use of internet services (hereinafter referred to as “Services”) provided by the Cyber Mall. ※ The terms of this Agreement shall apply to electronic commerce conducted through PC communication, wireless, etc., to the extent that it does not violate the nature of such commerce.
Article 2 (Definitions) ① The term “Mall” refers to a virtual business place set up by Enzychem Lifesciences USA Corp. using information and communication facilities such as computers, to provide goods or services (hereinafter referred to as “Goods”) to users, and is also used to refer to the business operating the Cyber Mall. ② “User” refers to a person who accesses the Mall and receives the services provided by the Mall in accordance with these terms, which includes both members and non-members. ③ “Member” refers to a user who has registered as a member of the Mall, thereby being eligible to continuously use the services provided by the Mall. ④ “Non-member” refers to a user who utilizes the services provided by the Mall without registering as a member.
Article 3 (Display, Explanation, and Amendment of the Terms) ① The Mall shall display the contents of this Agreement, the company’s name, the representative’s name, the address of the business office (including the address where consumer complaints can be processed), the phone number, fax number, email address, business registration number, telecommunication sales business report number, and the name of the person responsible for managing personal information on the initial service screen of the Cyber Mall so that users can easily recognize them. However, the content of the Agreement can be viewed by users through a linked screen. ② Before obtaining the user’s agreement to the terms, the Mall must provide a separate link or pop-up screen for users to review important items such as withdrawal rights, shipping responsibilities, and refund conditions, to ensure users can fully understand the terms. ③ The Mall may amend this Agreement in compliance with relevant laws, such as the Act on Consumer Protection in Electronic Commerce, the Act on Regulation of Terms and Conditions, the Basic Act on Electronic Documents and Electronic Transactions, the Electronic Financial Transaction Act, the Electronic Signature Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Door-to-Door Sales Act, and the Consumer Basic Act. ④ If the Mall amends the terms, it shall state the application date and reasons for the amendment alongside the current terms, and post the new terms from seven days prior to the application date to the day before the application date on the initial screen of the Mall. However, if the amendments are unfavorable to the user, the Mall shall provide a grace period of at least 30 days before making the changes. In such cases, the Mall shall clearly display the differences between the old and new terms to make them easily understandable for users. ⑤ Amendments to the Agreement apply only to contracts made after the application date, and for contracts made prior to the amendment, the previous version of the Agreement shall apply. However, if a user who has already entered into a contract wishes for the new terms to apply, they must notify the Mall of their request within the notice period of the amended terms, and the Mall must agree to this request. ⑥ Any matters not stipulated in this Agreement or the interpretation of this Agreement shall be governed by the Act on Consumer Protection in Electronic Commerce, the Act on Regulation of Terms and Conditions, the guidelines on consumer protection in electronic commerce determined by the Fair Trade Commission, and relevant laws or established practices.
Article 4 (Provision and Modification of Services) ① The Mall shall carry out the following tasks:
Posting or transmitting obscene or violent messages, images, or audio that goes against public order or morals.
Article 21 (Relation Between Linked and Linking Malls)
① If an upper-level Mall and a lower-level Mall are connected via hyperlinks (such as hyperlinked text, pictures, or videos), the former is referred to as a “linking Mall,” and the latter as a “linked Mall.”
② If the linking Mall indicates at the initial screen or the moment the link is established that it does not bear responsibility for transactions made independently by the linked Mall, the linking Mall is not responsible for such transactions.
Article 22 (Copyrights and Use Restrictions)
① Copyrights and other intellectual property rights of the materials produced by the Mall belong to the Mall.
② Users must not use information obtained through the Mall for commercial purposes or provide it to third parties without the Mall’s prior approval.
③ When the Mall uses copyrights assigned to users as per agreements, it must notify the users.
Article 23 (Dispute Resolution)
① The Mall must install and operate a complaint handling mechanism to reflect legitimate opinions or complaints from users and compensate for damages.
② The Mall shall prioritize handling complaints and feedback from users. If prompt handling is difficult, the Mall must inform the user of the reason and the processing schedule.
③ In the case of disputes between the Mall and users arising from electronic commerce transactions, if a user requests damage relief, the dispute may be mediated by the Fair Trade Commission or a dispute mediation institution requested by the local government.
Article 24 (Jurisdiction and Governing Law)
① Lawsuits related to electronic commerce disputes between the Mall and users shall be filed with the court having jurisdiction over the user’s address at the time of filing, or, if there is no address, the district court governing the user’s residence. If the user’s address or residence is unclear or the user resides abroad, the lawsuit shall be filed in accordance with the Civil Procedure Act.
② Korean law applies to lawsuits between the Mall and users regarding electronic commerce disputes.
Addendum
These terms and conditions are effective as of September 1, 2024.
Providing information on Goods or services and facilitating purchase contracts;
Shipping Goods or services for which purchase contracts have been made;
Other tasks specified by the Mall. ② If Goods or services are out of stock or if their specifications are modified due to technical changes, the Mall may modify the contents of Goods or services that will be provided in future contracts. In this case, the Mall shall promptly notify users by posting the updated information and effective date at the location where the current Goods or services are posted. ③ If the Mall modifies the contents of services agreed upon with users due to stock shortages or technical changes, the Mall shall immediately notify the users at an address where they can be reached. ④ In cases mentioned in paragraph 3, the Mall shall compensate users for any damages caused by such changes. However, the Mall shall not be held liable if it proves there was no intent or negligence.
Article 5 (Service Interruption) ① The Mall may temporarily suspend the provision of services in the event of maintenance, replacement, breakdown of computers or other information and communication equipment, or interruption of communication. ② The Mall shall compensate users or third parties for damages incurred due to temporary service interruptions. However, if the Mall proves there was no intent or negligence, it shall not be held liable. ③ In cases where the Mall can no longer provide services due to business transitions, business abandonment, or mergers, the Mall shall notify users in the manner prescribed in Article 8 and compensate users according to the conditions initially proposed by the Mall. If the Mall has not provided such compensation criteria, it shall compensate users with cash or items equivalent to the value of the mileage or points accumulated in the Mall.
Article 6 (Membership Registration) ① Users apply for membership by filling out the information requested by the Mall and agreeing to this Agreement. ② The Mall shall register as a member any applicant unless they fall under the following conditions:
The applicant has previously lost membership under Article 7(3) of this Agreement. However, those who have had their membership reinstated by the Mall after three years since the loss of membership shall be exempt from this restriction;
The registration contains false, omitted, or erroneous information;
The Mall finds that registering the applicant would significantly interfere with the Mall’s technical operations. ③ The membership contract is established when the Mall’s approval reaches the member. ④ If there is any change to the registered information, the member must notify the Mall within a reasonable period by modifying their member information.
Article 7 (Membership Withdrawal and Disqualification)
① Members can request to withdraw from the Mall at any time, and the Mall must process the membership withdrawal immediately.
② If a member falls under any of the following reasons, the Mall may restrict or suspend the member’s qualification:
If false information was registered at the time of application;
If the member does not pay for the goods or services purchased via the Mall or any other debts related to the Mall on the due date;
If the member obstructs the use of the Mall by others or misuses the information, thus disrupting electronic commerce order;
If the member engages in acts prohibited by law or these terms, or actions that violate public order and morals while using the Mall.
③ After the Mall restricts or suspends a member’s qualification, if the same act is repeated twice or more within 30 days, or if the reason is not corrected within 30 days, the Mall may disqualify the member.
④ If the Mall disqualifies a member, it will delete the member’s registration. In this case, the Mall will notify the member of this, and provide an opportunity for the member to explain themselves at least 30 days before the disqualification.
Article 8 (Notice to Members)
① When the Mall sends a notice to a member, it may use the email address designated by the member.
② For general notices to a large number of members, the Mall may substitute individual notifications by posting the notice on the Mall’s bulletin board for at least one week. However, for matters that may have a significant impact on a member’s transaction, the Mall will provide individual notices.
Article 9 (Purchase Application and Consent to Provide Personal Information, etc.)
① Users can apply for a purchase on the Mall by following the procedures provided, and the Mall must make the following clear so users can easily understand:
Searching and selecting goods, etc.;
Entering the recipient’s name, address, phone number, email (or mobile phone number), etc.;
Confirming terms and conditions, information regarding withdrawal rights, delivery charges, and installation fees, if any;
Agreeing to these terms and confirming (e.g., mouse click);
Applying for purchase of goods, etc., and confirming the application or receiving confirmation from the Mall;
Choosing a payment method.
② If the Mall needs to provide the buyer’s personal information to a third party, it must notify the buyer of the recipient, the purpose of use, the personal information being provided, and the retention and use period, and obtain the buyer’s consent. The same applies if there are changes to the information.
③ If the Mall entrusts the handling of personal information to a third party, it must inform the buyer of the recipient and the purpose of handling the personal information, and obtain the buyer’s consent. However, if the information is necessary for fulfilling the service contract and is related to user convenience, the Mall may notify users through its privacy policy instead of obtaining separate consent.
Article 10 (Formation of Contract)
① The Mall may refuse to accept a purchase application if it falls under any of the following categories:
The application contains false, omitted, or erroneous information;
The purchase is made by a minor who is attempting to buy goods prohibited by the Youth Protection Act (e.g., alcohol or tobacco);
Any other case where the Mall deems it difficult to process the purchase due to technical or other reasons.
② The contract is deemed formed when the Mall’s acceptance reaches the user in the form of a confirmation notice as per Article 12(1).
③ The Mall’s acceptance must include details of the user’s purchase application, availability of the purchase, and any correction or cancellation requests.
Article 11 (Payment Methods)
Payment for goods or services purchased from the Mall can be made using any of the following methods. The Mall must not charge additional fees for the payment method chosen by the user:
Account transfers through phone banking, internet banking, or email banking;
Payment via prepaid cards, debit cards, or credit cards;
Online deposit without a bankbook;
Payment using electronic currency;
Payment upon receipt of the product;
Payment using points or mileage provided by the Mall;
Payment via gift certificates issued by the Mall or other parties with agreements with the Mall;
Any other electronic payment methods allowed by law.
Article 12 (Confirmation Notice, Modification, and Cancellation of Purchase Application)
① Upon receiving a purchase application from a user, the Mall must send a confirmation notice.
② After receiving the confirmation notice, the user may request to change or cancel the purchase application if there is a discrepancy in their expressed intention, and the Mall must comply with such a request before shipment. However, if payment has already been made, cancellation must follow the procedures outlined in Article 15 (Right to Withdrawal).
Article 13 (Supply of Goods, etc.)
① Unless otherwise agreed, the Mall must take necessary steps such as production, packaging, and shipping of goods within seven days from the date of purchase. If the Mall has already received payment, it must begin these steps within three business days from the date of payment. The Mall must also ensure that users can track the status of their orders.
② The Mall must clearly specify the method, cost burden, and delivery time for the goods being shipped. If the Mall fails to meet the agreed delivery time, it must compensate the user for damages unless it can prove there was no intent or negligence.
Article 14 (Refunds)
If the Mall is unable to provide the goods or services purchased due to unavailability, it must promptly notify the user and refund the payment within three business days or take necessary steps for a refund.
Article 15 (Right to Withdrawal)
① A user who has entered into a contract with the Mall regarding the purchase of goods may withdraw from the contract within seven days of receiving the purchase confirmation notice under the Act on Consumer Protection in Electronic Commerce. However, if other laws provide differently, those provisions will apply.
② Users cannot request returns or exchanges under any of the following circumstances:
If the goods are damaged or destroyed due to the user’s responsibility (excluding damage caused by inspecting the goods);
If the value of the goods significantly decreases due to the user’s partial use or consumption;
If the value of the goods significantly decreases over time, making resale difficult;
If the packaging of the goods, which can be duplicated with equivalent performance, is damaged.
③ If the Mall did not clearly indicate restrictions on the right to withdrawal, or if it did not provide trial products, the user’s withdrawal right is not restricted in the cases mentioned in paragraph 2.
④ Notwithstanding paragraphs 1 and 2, if the goods or services do not match their advertised or contractual descriptions, the user may withdraw from the contract within three months from the date they received the goods, or within 30 days from the date they learned of the discrepancy.
Article 16 (Effect of Withdrawal)
① Upon receiving a returned product from the user, the Mall must refund the payment within three business days. If the Mall delays the refund, it must pay interest at the rate specified by the Enforcement Decree of the Act on Consumer Protection in Electronic Commerce.
② If payment was made using a credit card or electronic currency, the Mall must immediately request that the relevant service provider stop or cancel the transaction.
③ The user is responsible for the cost of returning the goods when withdrawing from the purchase, unless the withdrawal is due to discrepancies in the product’s description or a contractual violation, in which case the Mall must bear the cost.
④ If the user was charged for shipping when receiving the goods, the Mall must clearly inform the user of who is responsible for the cost in case of a withdrawal.
Article 17 (Personal Information Protection)
① The Mall shall collect the minimum necessary personal information from users to provide its services.
② The Mall shall not collect information necessary for fulfilling the purchase contract during membership registration. However, exceptions may apply if verification is required under relevant laws.
③ When collecting and using personal information, the Mall must inform users of the purpose and obtain their consent.
④ The Mall shall not use the collected personal information for purposes other than those agreed upon. If a new purpose arises or if the information is provided to a third party, the Mall must notify the user and obtain consent, except in cases allowed by law.
⑤ When obtaining consent to collect personal information, the Mall must specify the identity of the personal information manager, the purpose of collection, the information to be provided to third parties, and how long the information will be retained, as required by the Information and Communications Network Act. Users may withdraw their consent at any time.
⑥ Users may request to view or correct their personal information at any time, and the Mall must respond without delay. Until the correction is completed, the Mall must not use the relevant information.
⑦ The Mall is responsible for the loss, theft, leakage, or alteration of personal information, as well as unauthorized provision to third parties, and must compensate users for any resulting damages.
⑧ The Mall or any third party receiving personal information from the Mall must destroy the information without delay once the purpose for collecting it has been achieved.
⑨ The Mall shall not pre-select user consent to the collection, use, or provision of personal information. Additionally, the Mall must specify the services that will be restricted if users do not consent, but may not deny services or restrict membership based on refusal to provide non-essential personal information.
Article 18 (Mall’s Obligations)
① The Mall must not engage in actions prohibited by law or contrary to public morals and must do its best to provide goods and services continuously and securely according to the terms of this Agreement.
② The Mall must establish a security system to protect the personal information of users to ensure a safe internet service environment.
③ If the Mall causes damage to users through fraudulent advertising, it must compensate the users.
④ The Mall must not send unsolicited commercial emails to users without their consent.
Article 19 (Member’s ID and Password Responsibilities)
① Members are responsible for managing their ID and password, except for cases stipulated in Article 17.
② Members must not allow third parties to use their ID and password.
③ If a member’s ID or password is stolen or used by a third party, the member must notify the Mall immediately and follow the Mall’s instructions.
Article 20 (User’s Obligations)
Users must not engage in the following actions:
Registering false information during application or updates;
Using someone else’s information;
Modifying information posted on the Mall;
Transmitting or posting information other than what the Mall specifies (such as computer programs);
Infringing on the intellectual property rights of the Mall or any third party;
Damaging the reputation of the Mall or interfering with its operations;
Posting or transmitting obscene or violent messages, images, or audio that goes against public order or morals.
Article 21 (Relation Between Linked and Linking Malls)

④ If the Mall disqualifies a member, it will delete the member’s registration. In this case, the Mall will notify the member of this, and provide an opportunity for the member to explain themselves at least 30 days before the disqualification.
Article 8 (Notice to Members)
① When the Mall sends a notice to a member, it may use the email address designated by the member.

Article 16 (Effect of Withdrawal)
① Upon receiving a returned product from the user, the Mall must refund the payment within three business days. If the Mall delays the refund, it must pay interest at the rate specified by the Enforcement Decree of the Act on Consumer Protection in Electronic Commerce.
② If payment was made using a credit card or electronic currency, the Mall must immediately request that the relevant service provider stop or cancel the transaction.
③ The user is responsible for the cost of returning the goods when withdrawing from the purchase, unless the withdrawal is due to discrepancies in the product’s description or a contractual violation, in which case the Mall must bear the cost.
④ If the user was charged for shipping when receiving the goods, the Mall must clearly inform the user of who is responsible for the cost in case of a withdrawal.
Article 17 (Personal Information Protection)
① The Mall shall collect the minimum necessary personal information from users to provide its services.
② The Mall shall not collect information necessary for fulfilling the purchase contract during membership registration. However, exceptions may apply if verification is required under relevant laws.
③ When collecting and using personal information, the Mall must inform users of the purpose and obtain their consent.
④ The Mall shall not use the collected personal information for purposes other than those agreed upon. If a new purpose arises or if the information is provided to a third party, the Mall must notify the user and obtain consent, except in cases allowed by law.
⑤ When obtaining consent to collect personal information, the Mall must specify the identity of the personal information manager, the purpose of collection, the information to be provided to third parties, and how long the information will be retained, as required by the Information and Communications Network Act. Users may withdraw their consent at any time.
⑥ Users may request to view or correct their personal information at any time, and the Mall must respond without delay. Until the correction is completed, the Mall must not use the relevant information.
⑦ The Mall is responsible for the loss, theft, leakage, or alteration of personal information, as well as unauthorized provision to third parties, and must compensate users for any resulting damages.
⑧ The Mall or any third party receiving personal information from the Mall must destroy the information without delay once the purpose for collecting it has been achieved.
⑨ The Mall shall not pre-select user consent to the collection, use, or provision of personal information. Additionally, the Mall must specify the services that will be restricted if users do not consent, but may not deny services or restrict membership based on refusal to provide non-essential personal information.
Article 18 (Mall’s Obligations)
① The Mall must not engage in actions prohibited by law or contrary to public morals and must do its best to provide goods and services continuously and securely according to the terms of this Agreement.
② The Mall must establish a security system to protect the personal information of users to ensure a safe internet service environment.
③ If the Mall causes damage to users through fraudulent advertising, it must compensate the users.
④ The Mall must not send unsolicited commercial emails to users without their consent.
Article 19 (Member’s ID and Password Responsibilities)
① Members are responsible for managing their ID and password, except for cases stipulated in Article 17.
② Members must not allow third parties to use their ID and password.
③ If a member’s ID or password is stolen or used by a third party, the member must notify the Mall immediately and follow the Mall’s instructions.
Article 20 (User’s Obligations)
Users must not engage in the following actions:
Registering false information during application or updates;
Using someone else’s information;
Modifying information posted on the Mall;
Transmitting or posting information other than what the Mall specifies (such as computer programs);
Infringing on the intellectual property rights of the Mall or any third party;
Damaging the reputation of the Mall or interfering with its operations;
